MEMBERSHIP AGREEMENT

This Membership Agreement (the "Agreement") is entered into between Stud Model Project ("Agency") and the member ("Member") as of the date of acceptance.

1.  Membership Terms

a. Annual Membership: The Membership is valid for a period of 12 months from the date of acceptance.

b. Monthly Subscription: Members have the option to subscribe to additional services on a month-to-month basis, billed separately.

c. Cancellation or Suspension: Members may cancel or suspend their membership at any time without penalty or cancellation fees. Annual membership and monthly subscription fees are non-refundable once payment has been processed. Monthly subscriptions can be suspended for up to 90 days with a request made to the staff.

 

2.  Membership Benefits

a. Access to Membership App: Members will have access to the Stud Model Project Membership App, which includes features such as members-only groups, shoot calendar, events, and casting calls.

b. Complimentary Headshot: Members will receive one complimentary headshot session during their 12-month membership period. Active membership is required to utilize this complimentary session.

c. Complimentary Access to Staff & Resources: Members can communicate with industry professionals and staff through the chat option on the website and app for tips and feedback.

d. Access to Photoshoot Calendar: Members can view the photoshoot calendar and subscribe to monthly plans and photoshoot sessions to build their portfolio.

e. Access to Limited Online Training: Members have limited access to the training program, with advanced training available to monthly subscribers.

f. Access to Exclusive Workshops & Events: Members gain exclusive access to public and private events and workshops hosted, promoted, or sponsored by Stud Model Project.

g. Access to Online Model Lounge: Members can join a community of models, share ideas, seek support, promote their work, and network with others. Stud Model Project is not responsible for acquiring gigs on behalf of the members.

 

3.  Membership Fees

a. Annual Membership: The annual membership fee is $118, billed annually until canceled.

b. Monthly Subscription Plans: Two monthly subscription plans are available - SMP LOCAL PLAN ($59), and SMP NON-LOCAL PLAN ($29). All plans can be canceled at any time without penalty.

c. Refunds and Chargebacks: Once payment has been processed, no refunds will be provided. In the event of an error, members should contact Stud Model Project for a payment review. Chargebacks initiated without prior contact may result in membership revocation and account flagging.

 

4.  Safety Measures

a. Member Responsibility: Members are responsible for their own safety, as well as the safety of any guests they bring to photoshoots, events, or workshops.

b. Styling and Session Sharing: Members are responsible for styling themselves for each photoshoot and agree to share their sessions with other paying members.

c. Stud Model Project Facilities: Stud Model Project will provide clean, safe, and private spaces for members to create freely. However, the agency does not reimburse for travel, boarding, medical expenses, or other accommodations related to attending its services.

 

5.  Termination

a. Termination Grounds: Members can be terminated for violating the Membership Agreement, Terms and Conditions, or the Photo Purchase and Download agreement.

b. Intellectual Property: All images, videos, and creative properties captured by Stud Model Project photographers are the sole property of the agency. Members may purchase limited rights to their raw files for personal use only. Sharing raw images or videos captured by the staff is prohibited.

 

6.  Dispute Resolution

a. Initial Resolution: In the event of any dispute or disagreement arising under this Agreement, the Member agrees to first attempt to resolve the matter amicably by contacting Stud Model Project directly. The Member shall provide a detailed written notice of the dispute and allow Stud Model Project a reasonable period of 60 days to address and resolve the issue.

b. Further Steps: If the dispute remains unresolved after the initial resolution attempt, the Member may escalate the matter by filing a report with the Better Business Bureau (BBB) or any relevant consumer protection agency in their jurisdiction.

c. Legal Action: If the dispute is not resolved through the above steps, the Member may seek legal remedies available in accordance with the laws of the United States and the State of Georgia, as Stud Model Project is headquartered in Georgia.

 

7.  Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Georgia, without regard to its conflict of laws principles.
