In these Terms and Conditions, the “Agency” refers to Stud+ Model Project (SMP), the “Client” refers to the person, company, or entity engaging the Agency, and the “Talent” refers to the model, influencer, or artist providing services for the booking.

1. TERMS AND CONDITIONS

1.1. These Terms and Conditions override any other agreements unless otherwise agreed in writing before the booking.

1.2. These Terms should be read in conjunction with the Booking Confirmation and invoice. The Client is responsible for notifying all relevant parties about these Terms.

1.3. Any variations to these Terms must be agreed upon in writing by the Agency.


2. BOOKINGS

2.1. A Booking Confirmation outlining all terms must be returned by the Client before the work begins. Provisional bookings must be confirmed within 24 hours; otherwise, the Agency reserves the right to accept guaranteed bookings.

2.2. Amendments or changes to bookings must be communicated to the Agency before returning the Booking Confirmation.

2.3. All Talent introduced by the Agency must be booked directly through the Agency.


3. FEES

3.1. The minimum booking period is 2 hours.

3.2. A day rate covers an 8-hour period, including a 1-hour lunch break. Half-day bookings are 4 hours. Additional hours are charged as overtime.

3.3. Overtime Rates:

• Between 9 AM and 6 PM: Charged at the normal hourly rate.

• Before 9 AM and after 6 PM: Charged at 1.5 times the hourly rate.

• Sundays and holidays: Charged at double the hourly rate.

3.4. Fitting bookings require a minimum of 2 hours, billed at an hourly rate thereafter.

3.5. All fees must be paid directly to the Agency, including applicable Agency commissions.


4. USAGE RIGHTS

4.1. Usage rights must be agreed upon at the time of booking. The standard fee covers one image for one year in the agreed territory and medium.

4.2. Additional fees apply for extended usage, including additional years, territories, or purposes beyond the original agreement.

4.3. It is the Client’s responsibility to notify the Agency of any subsequent usage beyond the initial agreement.


5. MODEL EXPENSES

5.1. Travel and accommodation expenses are chargeable and must be covered by the Client.

5.2. Travel days will be billed at half the agreed day rate.

5.3. Per diems will be charged for overnight stays.

5.4. If the Client requests the Agency to arrange travel or accommodation, an additional 20% administration fee will apply.

5.5. Travel expenses must be reimbursed within 7 days of the invoice issue date.


6. INVOICES AND PAYMENTS

6.1. Payment of all fees and expenses is due within 30 days of the invoice date unless otherwise agreed in writing.

6.2. Invoice queries must be raised within 48 hours of receipt.

6.3. No usage rights are granted until payment is received in full.

6.4. Late payments will incur a 10% overdue fee.


7. CANCELLATIONS

7.1. Cancellations within 1 business day of the booking start time will incur the full fee unless rebooked immediately.

7.2. Cancellations within 2 business days will incur 50% of the fee unless rebooked.

7.3. Talent cancellations due to illness or other uncontrollable circumstances are not subject to charges.


8. COPYRIGHT AND USE OF IMAGES

8.1. The Client and photographer may not use images beyond the agreed terms without written permission from the Agency.

8.2. It is the Client’s responsibility to ensure that photographers comply with these terms.


9. INSURANCE AND SAFETY

9.1. The Client must ensure that Talent is treated respectfully and provided with a safe working environment.

9.2. The Client is responsible for ensuring adequate insurance, including third-party liability, for all bookings.


10. LIABILITY

10.1. The Agency is not liable for any losses incurred due to Talent cancellations, no-shows, or delays.


11. DATA PROTECTION

11.1. The Client must comply with all applicable data protection laws.

11.2. Any personal data shared by the Agency must be used solely for the purpose of the booking.


12. COMPLAINTS

12.1. Complaints must be reported immediately to the Agency. Issues raised after the booking has concluded will not be considered.

12.2. The Agency is not responsible for the behavior or conduct of self-employed Talent during bookings.
